A session of the Property and Investment Alliance and the BFC Club was held on the the Bill on Special Conditions for Recording and Registration of Property Rights to Real Estate

The Bill on Special Conditions for Recording and Registration of Property Rights to Real Estate was adopted at the Government session on September 26, and its adoption in the National Assembly is expected during October.

On this occasion, a joint session of the Property and Investment Alliance and the BFC Club of Cities and Municipalities with a Favorable Business Environment was held on Tuesday, September 30, as the digitalization and acceleration of the legalization process have for years been among the key priorities of these program bodies and NALED’s Grey Book (recommendation 5.1).

- With this law, citizens will finally have the opportunity to officially own the properties where they live or work, the state will gain a well-organized system and an up-to-date record of existing buildings, and society as a whole will benefit from legal certainty regarding property rights - said Đorđe Milić, Director of the Agency for Spatial Planning and Urbanism, the institution that will play a leading role in implementing the law.

NALED’s Program Director Jelena Bojović highlighted some of the key novelties in the Bill, such as the possibility to register ownership without urban planning conditions, the introduction of a unified electronic platform for submitting applications, centralized decision-making, and the official collection of documentation.

- Citizens will be able to submit simple applications via the electronic platform, while the Agency for Spatial Planning and Urbanism will collect data officially and issue confirmations based on which the Real Estate Cadastre (RGZ) will carry out the registration. In cases prescribed by law, these two institutions will conduct a so-called ‘minor validation’ process to align records with the actual situation on the ground - Bojović explained.

Dušan Vasiljević, Director of NALED’s Department for Competitiveness and Investments, reminded participants of the Framework Proposal for Comprehensive Reform of Real Estate Management and Disposal, developed by NALED in 2023 with the support of the Government of the Kingdom of Sweden, following extensive analyses and a broad public-private dialogue. This study and the Grey Book recommendation served as the basis for some of the key solutions incorporated into the Bill.

- For the first time, this Bill enables large-scale and nearly universal registration of property rights, covering millions of properties previously outside the system. This represents a stable foundation for a regulated real estate market and urban development - Vasiljević noted.

To carry out registration, a separate application must be submitted for each individual property. In most cases, registration fees will range from €100 to €1,000, with a portion of the revenue directed to local governments. Exempt from paying the fee will be recipients of social assistance, persons with disabilities, war veterans, single parents, and families with three or more children.

Since the Bill has not yet been adopted, it should be noted that certain details or deadlines may change during the parliamentary procedure through amendments. NALED members shared their suggestions for improvement at the session. The latest information on property registration, as well as the most frequently asked questions and answers, will be regularly updated on the website svojnasvome.gov.rs.
